Acceptance of Terms

By accessing or using the services provided by X-AEROMATICS ("we", "us", or "our"), you agree to comply with and be bound by these Terms of Service, along with our Privacy Policy and Cookie Policy. If you do not agree to these terms, you are prohibited from using our services. These terms apply to all visitors, users, and others who access or use our services.

Description of Services

X-AEROMATICS provides the following services:

• SaaS Products: Hangar Cloud (drone fleet management platform), Flight Log Analyser (drone tuning and analysis software)
• Drone Services: Aerial cinematography, enterprise & industrial solutions, precision agriculture, professional drone training
• Physical Products: Drone hardware, components, and related equipment sold through our online store
• Payment Processing: All payments are processed through Lemon Squeezy, our authorized payment processor

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without notice.

Account Registration and Security

When creating an account for our SaaS products, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Subscription and Payment Terms

For subscription-based SaaS products:

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Payment processing is handled by Lemon Squeezy under their terms of service
• You authorize Lemon Squeezy to charge your payment method for the subscription fees
• Subscription fees are non-refundable except as required by law
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period

For physical products and one-time service purchases:

• Payment is due at the time of purchase
• All sales are final unless otherwise specified
• Shipping and delivery terms are specified at checkout

Acceptable Use

When using our services, you agree to:

• Use the services only for lawful purposes and in compliance with all applicable laws and regulations
• Not use our services for any illegal or unauthorized purpose
• Not engage in any activity that could harm or disrupt the services, servers, or networks
• Not attempt to gain unauthorized access to our systems or other users' accounts
• Not use our services to transmit, distribute, or store any illegal, harmful, or offensive content
• Comply with all drone aviation regulations and local laws when using our drone-related services
• Not reverse engineer, decompile, or disassemble any software or proprietary aspects of our services

Intellectual Property Rights

All content and materials available through our services, including software, text, images, designs, and trademarks, are the intellectual property of X-AEROMATICS or our licensors. You are granted a limited, non-exclusive, non-transferable license to use our services for your personal or business purposes in accordance with these terms. Any reproduction, distribution, or modification of these materials without prior written consent is prohibited.

You retain ownership of any data you upload to our services, but grant us a license to use, process, and store such data solely for the purpose of providing our services to you.

Drone Service Specific Terms

For drone services (aerial cinematography, industrial solutions, agriculture, training):

• All drone operations comply with local aviation regulations and safety standards
• Customers must provide suitable operational locations and obtain necessary permits
• Weather conditions may affect service delivery and may require rescheduling
• Customers are responsible for ensuring safe operating conditions
• Training services include certification preparation but do not guarantee regulatory approval

Physical Product Terms

For physical products sold through our store:

• All products are subject to availability
• We reserve the right to limit quantities of products purchased
• Products are covered by manufacturer warranties as specified
• Customers are responsible for customs, duties, and import taxes for international shipments
• Drone hardware requires proper registration and compliance with local regulations

Analytics and Tracking

We use Google Analytics, Meta Pixel, and PostHog to analyze website traffic and user behavior. These tools collect information about how you use our services, which helps us improve our offerings. By using our services, you consent to the collection and use of this data as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by applicable law, X-AEROMATICS shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill arising out of your access or use of our services. Our total liability for any claims related to our services shall not exceed the amount you paid for the services in the preceding twelve months.

For drone services, we are not liable for damages caused by weather conditions, regulatory restrictions, or factors beyond our control.

Indemnification

You agree to indemnify and hold X-AEROMATICS harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms of Service, your violation of any rights of another, or your operation of drones or use of our products.

Termination

We may terminate or suspend your access to our services without prior notice or liability for any reason, including if you breach these Terms of Service. Upon termination, your right to use the services will immediately cease. For subscription services, no refunds will be provided for the current billing period.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting the updated terms on our website. Your continued use of the services after the posting of changes constitutes your acceptance of the modified terms. We will notify you of material changes via email or prominent website notice.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law principles. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
